Not always, I know a couple of fan games based on freeware games.

As for Sam and Max fangames, can't say I've seen any. I did see a Day of the Tentacle fangame once, which looked to have Sam and Max in it, but I can't remember where.

For a fan game, their sample MP3 is surprising very good.

I'm usually not keen on fan media, because the familiar characters are often clumsily handled by people who don't understand them well enough to write for them. I quite enjoyed that 'What Makes You Tick' tribute to Monkey Island posted somewhere in the Telltale Forums, because it had its own original characters even if it drew from Monkey Island in other places. I wonder if there's anything else like that out there.
