I'm quick witted, not a law attorney. I heard that sometimes people might be tried with Murder if their negligence lead to the death, so I figured why not?

His social skills are certainly lacking. Most think this means not talking, but it could also mean talking when you shouldn't (not reading the situation right.) Like with Clementine after first arriving to the Motor Inn. Until that point I just figured he's just really really stupid. But after that it kinda clicked and I remembered a similar vibe from a kid I used to know that had it. Again, minus the Genius bit. But people with mild Cases don't have to have all the symptoms, or even really strong symptoms. (Some people even argue as to whether or not it actually exists, or is just a mash up of various abnormal character traits.)

And then that child ran over the adult.
The assertion was that we don't blame kids for crimes or put them on trial for them. That's not really true, kids not only can be held responsible according to the laws on the books in certain states, but are. It's just that most cases involving kids go to family court.

Hell, it was only a few years ago that New York put a 9 year old kid on trial for Manslaughter. California charged a 10-year old kid with murder within the past year, etc. so yeah, it does happen, even in first-world countries.

In the case of kids that were a year or two older, they were tried and convicted as adults; e.g. Lionel Tate was sentenced to life for something he did at the age of 12, Nathaniel Abraham was likewise tried as an adult and convicted for something he did when he was 11.

About putting children on trial...

It's not unprecedented, but it is rare. Usually prosecutors have to PROVE to a trial judge that the child in question was indeed capable of understanding the consequences of their actions. I doubt that more than a handful of cases in recent history have managed to come up with that kind evidence.

There's a reason that certain things are kept off limits for children until they reach a certain age (18 in America) - it's an acknowledgement that a "child" does not understand the full impact of their actions.

Load of crap, I remember when I was around 10. I knew what rape, murder, sex, drugs, etc, was and the consequences for those actions. Didn't keep me from thinking about killing my 1rst grade teacher. (Brought a toy gun to school and scared the crap out of her, XD.)

Don't worry, I've improved A LOT since childhood. Yes, think how poorly of an opinion you have of me as I am NOW, and know that in comparison the child I used to be was a selfish, sick, twisted, cruel, and diabolical little demon. The whole no killing kids thing you talked about before? If I could go back in time it'd bring whole new meaning to "Homicide Suicide". XD

It's not crap. It's one thing to say that a kid understands good and bad - it's another thing to expect said kid to understand all of the subtle nuance in the judicial system and how their actions will be scrutinized by it.

If you HONESTLY understood what murder/etc. was as a child, then you were one of the "rare" exceptions that I was talking about. Don't pretend that because you did, though, that EVERY kid does.

It's not just me though, I used to talk about it with kids in my class and some of my close friends and I look back on it... Maybe I'm just surrounded by exceptions. But I'd think kids aren't as innocent as you'd like to believe.

School yards are always some of the crueler and most drama filled environments. (Granted Elementary is no where near as bad as Middle School) I learned Fuck at the age of 5 on the school bus, from another kid, and it passed around all of school. Kids using racial slurs, talking about porn, etc. Maybe it's because I'm just about to turn 20, so I'm from one of the younger generations, but still. Kids do some wicked evil crap to each other, in and out of school.

I love these arguments about Duck. It's like watching both sides whipping each other with long stands of overcooked spagetti - no one gets any where in the discussion. Lol.

In any case, Shaun / Kenny were partially responsible for putting Duck on a tractor anyway. I wouldn't put my kids anywhere near heavy machines. So Shaun's accident was unfortunate, but we can't blame Duck for it. Still, kinda strange no one said anything about the fact that a bunch of people thought it was OK to put a kid on a tractor.
