These are the official rules of the 'Sam & Max: The Devil's Playhouse Contest' (the "Contest").
In these rules, "we," "our," and "us" refer to Telltale, Inc. ("Telltale"), the sponsor of the Contest. "You" refers to an eligible participant in the Contest. There are no other sponsors of this Contest.
1. START AND END DATES: The Contest starts on April 8, 2010 and ends at midnight (PST) on April 30, 2010 (" the Contest Period").
2. ELIGIBILITY REQUIREMENTS: The Contest is only open to residents of the United States and no other countries or jurisdictions (and this Contest is not open to residents of Puerto Rico). You are eligible to enter this Contest if you meet the following requirements at the time of entry:
You are 18 years or older. If you are 18 years of age or older, and are considered a minor in your place of residence, you are not eligible to enter. You are a resident of the United States. You (or any member of your immediate family) are not an employee or agent of Telltale, Inc. If you are chosen as a prize winner you will be required to sign a release (the "Release"), which will, subject to applicable law, release Telltale from any liability and also give Telltale the right (but not an obligation) to use your name in connection with advertising, promotion and marketing related to Telltale or its products and also in connection with publicly announcing your name as a winner of the Contest. The right for Telltale to use your name will be irrevocable, worldwide and will last in perpetuity and not subject to any further consideration, review, permission or approval.
This Contest is subject to all applicable national, state, local laws and regulations and is void where prohibited by law. Awarding of any prize is subject to verification of the winner.
3. CONTEST REGISTRATIONS AND SUBMISSIONS:
Entries to the Contest are to be submitted online at: http://www.telltalegames.com/thepenalzone-ipad. To register for the Contest, you must enter your name and e-mail address.
By participating in the Contest, you agree to be bound by these Official Rules and the decisions of Telltale.
If for any reason the Contest is not capable of running as planned, including, without limitation, as a result of infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Telltale which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Telltale reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Contest and to award all prizes from among all eligible entries received prior to (or after, if applicable) action taken by Telltale.
4. FORMAT AND LIMITATION ON ENTRIES
You may only submit one entry to the Contest. Only one entry per person (and per valid e-mail address) is acceptable. Any attempted form of entry into this Contest other than as described is void. Telltale is not responsible for any change of email address, mailing address and/or telephone number of entrants. You may not enter with multiple email addresses. Any entrant who attempts to play with multiple email addresses or under multiple identities will be disqualified from participation in the Contest and all entries by that entrant will be void. In case of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter the Contest at the time of entry will be considered the entrant. Use of a robotic, macro, automatic, programmed or similar entry methods will void all such entries.
5. PRIZES
One First Prize Winner will receive a 16GB Apple iPad and the full season pass to 'Sam & Max: The Devil's Playhouse' (Apple, Inc. is not a sponsor of nor affiliated with this Contest). Five Second Prize Winners will receive a full season pass to 'Sam & Max: The Devil's Playhouse.' Playing 'Sam & Max: The Devil's Playhouse requires a computer with certain minimum specifications. The retail value of the First Prize is $533.95. The value of each of the Second Prizes is $34.95. All taxes associated with a winner receiving a prize are the sole responsibility of the winner.
6. WINNER SELECTION AND NOTIFICATION
Odds of winning depend on the total number of eligible entries received during the Contest Period. Potential winners will be selected in a random drawing to be held on or about May 1, 2010 and selected from entries received during the Contest Period. Potential winners will be notified by e-mail to the address submitted with the potential winner's entry within two (2) weeks after the drawing. The drawing will be conducted by Telltale. If you are a winner of the Contest, we will notify you by sending a message to the e-mail address, listed on your entry within ten (10) days following the selection of the winners. If the notification that we send is returned as undeliverable, or you are otherwise unreachable for any reason, or if a winner does not sign and return the Release within ten (10) days of it being sent by Telltale then an alternate winner may be chosen in place of such selected winner and the originally selected winner will be disqualified. Only one (1) First Prize winner and five (5) Second Prize winners will be selected.
Prizes listed may be substituted for other prizes of equal value, based on availability.
7. LIMITATION OF LIABILITY
By participating in this Contest, you agree to release Telltale and its employees, as well as each of their respective successors, representatives and assigns from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest. All entries are sent at your own risk and Telltale cannot accept liability for any loss of or damage to any Submitted Material.
8. DISPUTES
You agree that any claim or controversy arising out of or related to the Contest shall be settled by expedited binding arbitration in accordance with the rules of the American Arbitration Association. Such arbitration shall take place in Marin County, California, and you waive any claim that such forum is inconvenient. Any such claim or controversy shall be arbitrated solely on an individual basis and shall not be consolidated with a claim of any other party. The Arbitrator may not change the terms of this Agreement and may not award any injunctive or other equitable relief.
9. PRIVACY
Telltale's Privacy Policy will apply to this Contest and to all information that we receive from your entry. Please read the Privacy Policy on the telltalegames.com website before submitting your entry. Your submission of an entry will constitute your acceptance of these Official Rules and the terms of the Privacy Policy located at: www.telltalegames.com/privacypolicy.
10. DISCLAIMERS
By entering the Contest, you agree and acknowledge to be bound by the Official Rules, as well as the decisions of Telltale which are final and binding in all respects; to waive any rights to claim ambiguity with the Official Rules, and that Telltale and shall have no responsibility or liability (including, but not limited to, liability for property loss, damage, personal injury or death) in connection with: participation in the Contest; technical or mechanical error(s) on the website; typographical error(s) in Contest promotional material; acceptance/possession, defects, and/or use/misuse of prizes, human error; incorrect or inaccurate transcription of entry information; any technical malfunction(s) of the telephone service, telephone network, computer online system, computer equipment, software, or internet service provider utilized by Telltale or by you; interruption or inability to access the Contest, any Contest-related web pages, or any online service via the internet due to hardware or software compatibility problems; any damages to your (or any other person's) computer and/or its contents related to or resulting from any part of the Contest; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of Telltale. You further agree to indemnify and hold harmless Telltale from any and all liability resulting or arising from the Contest and to release all rights to bring any claim, action or proceeding against Telltale. Winners release Telltale from any and all liability/responsibility with respect to the prizes won (including any property loss, damage, personal injury, or death). Telltale shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity that may be caused or contributed to (i) by any wrongful, negligent or unauthorized act or omission on the part of Telltale, or any of its respective agents, servants, employees or independent contractors, (ii) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Telltale, or (iii) by any other cause, condition or event whatsoever beyond the control of Telltale.
